Facility’s special records department chief unauthorized extends term of imprisonment for head of Journalists Union of Kazakhstan Matayev

Almaty. November 1. KazTAG - LA 155/14 facility’s special records department chief Zhanna Sharmanova unauthorized extends term of imprisonment for the head of Journalists Union of Kazakhstan Matayev, making “mistakes” in calculating imprisonment term with suspicious regularity, the Kazakh Telegraph Agency (KazTAG) reports.
“There is early release on parole, there are also other options, allowing them to serve their sentences not at the facility, but under less harsh conditions, especially taking in account Seitkazy’s serious health problems. I cannot say the names of people who impede it, simply because I do not know them. For some reasons, facility’s special records department chief Zhanna Sharmanova calculates the timing for Matayev’s early release in the wrong way. She had been given an explanation and then formally admitted her mistake, yet now again starts adding another 8 months to the term,” acting chairperson of the union of journalists Tamara Kaleyeva told “Zonakz” information portal.
With this, she stressed, due to incorrectly calculated terms, the courts deny the lawyers’ appeals for parole for S. Matayev.
“In October and even in July he had his legal right to be released on parole. This would allow him to take more care of his health”, T. Kaleeva stressed.
To note, Zh. Sharmanova seems making such “mistakes” systematically.
E.g., in June 2017, at a court session in the presence of Judge Zhanbolatov, Zh. Sharmanova presented a certificate saying 1/3 of the term of Seitkazy Matayev would come on September 26, 2017, thus, Matayev’s petition has been declined, as the next terms for petition would come in 6 months. Then it turned out that Zh. Sharmanova made a “mistake”, while S.Matayev received a notice that 1/3 of the term came on July 11, 2017.
On October 6, 2017 S. Matayev filed an application for parole. The application was rejected, as according to Zh. Sharmanova’s calculations, the right term would come on October 7, 2017. With this she was aware of the fact that the term of S.Matayev had been reduced by eight months under the amnesty and by the court’s decision. However, when requested by S.Matayev, Zh. Sharmanova once again presented the distorted data, having unauthorized raised the custodial penalty term, thus, not only violated the rights and legitimate interests of S.Matayev, but meant that she committed misdemeanor.
If under the law 1/3 of the term came on March 13, 2017, 1 // 2 (release on parole) - on June 27, 2017, and the end of the term comes on June 13, 2018, then according to contradictory not only to the law, but elementary arithmetic calculations of Zh. Sharmanova, 1/3 of the term came on June 12, 2017, 1 // 2 (release on parole) on October 17, 2017, and the end of the term comes on November 01, 2018.
In this regard, S.Matayev applied with a statement to the chairman of the NSC Karim Massimov with a request to bring Zh. Sharmanov to criminal responsibility for power abuse under Article 362 of the Criminal Code of the Republic of Kazakhstan. On October 13, 2017, S.Matayev sent the statement to the facility’s special records department chief Zhanna Sharmanova for registration and dispatch to the NSC. In violation of the order of the Ministry of Internal Affairs of the Republic of Kazakhstan No. 819 (p.71, p.72), the statement was not registered or dispatched.  Apparently, selfish interests and personal gain prevailed over the official duties and duty of a civil servant.
Zh. Sharmanova showed neglected attitude to another application of Seitkazy and Aset Matayevs. They prepared the document to be sent to the deputies of European Parliament (Brussels, Belgium), while the special records department sent it to the representation of the European Union in Kazakhstan (Astana, Kazakhstan).
The agency asks Kalmukhanbet Kasymov, Minister of Interior Affairs of Kazakhstan, to pay attention to these and other violations, incompatible with a duty of state servant and employee of the law enforcement bodies.
