Kazakhstan’s officials are convicted based on evidences by their subordinates, Prosecutor-General’s Office

Almaty. November 9. Silkroadnews – There are cases in Kazakhstan when the officials accused of corruption and official crimes are convicted based on evidences by the subordinates only, Zhakip Asanov Prosecutor General of the Republic of Kazakhstan said, KazTAG writes.

“Or let’s consider the evidences, especially in official and corruption crimes. There are evidences by 2-3 subordinates. They give evidences against their boss and in exchange for it get exempt from their punishment. No other evidences are there. Will it be sufficient for judgement of conviction?”, Z. Asanov said at the meeting in Astana on Wednesday.

“There is an opinion that the “reasonable terms” concept has resulted in red tape. The criminal procedure code has given a number of powers to attorneys, but has not provided for the mechanism of their implementation. The prosecutors have an old stereotype: being afraid of acquittal judgements. Not everything is clear on the procedural transactions, when prosecutors and judges decide to make concessions in negotiations with the suspect and give a minimum punishment”, he added.

Z. Asanov also added, when developing the penal code and criminal procedure code, the authors did not take into account the intersectoral conflicts.

“Quite often we see cases when people try to transfer ordinary economic disputes into the category of criminal proceedings and incite against the opponent using the law enforcement mechanism. Such problematic issues are quite common”, the public prosecutor summarized.
