Kazakhstan ratified agreement with Iran on transfer of sentenced persons

Almaty. January 11. Silkroadnews – President of Kazakhstan signed the law of Kazakhstan “On ratification of the Agreement between the Republic of Kazakhstan and the Islamic Republic of Iran on the transfer of sentenced persons”, press service of Kazakhstan’s president reported.

As KazTAG previously wrote, the law passed says a sentenced person may be transferred if the person is a national of the administering state, if the judgment is final and entered into force according to the national law of the sentencing state.

At the same time the transfer is to be provided if at the time of receipt of the request for transfer, the sentenced person still has at least six months of the sentence to serve; if the convicted person consents to his/her transfer or the transfer is requested by his/her close relatives or legal representative because of his/her physical or mental condition.

All the costs associated with the transfer of the sentenced person from the moment of transfer to the administering state shall be borne by the administering state.

Agreement between Kazakhstan and Iran on the transfer of sentenced persons was made in Tehran on April 11, 2016.
